These Terms & Conditions apply to the use of this website and to all purchases, commissions, enquiries, original artworks, and Fine Art Prints offered by Sharan Miller Animal Art.
By using this website, submitting an enquiry, or purchasing artwork, you agree to these Terms & Conditions.
2. Artwork & Product Information
Every effort is made to accurately represent artwork through photography and descriptions.
Due to differences in screen settings, lighting, and photography, colours and details may vary slightly from those displayed online.
All original artworks are individually created by hand and may contain natural variations that form part of the artwork's unique character.
3. Commissioned Artwork
Commissioned artwork is created specifically for the client using supplied reference photographs and agreed specifications.
A commission booking is confirmed once the artwork details have been agreed and any required deposit has been received.
The artist reserves the right to decline a commission request at her discretion.
Changes requested after work has commenced may result in additional fees and revised completion timeframes.
4. Reference Photographs & Copyright
Clients are responsible for providing suitable reference photographs for commissioned artwork.
By supplying reference photographs, the client confirms that they either:
• own the copyright to the photographs; or
• have obtained permission from the copyright owner for their use in the creation of artwork.
The client accepts full responsibility for ensuring that any photographs supplied may legally be used for artistic reference purposes.
Sharan Miller Animal Art accepts no liability for any copyright infringement, claims, disputes, or legal action arising from photographs provided by a client.
The artist reserves the right to refuse any commission where the copyright status of reference images is unclear or where permission cannot be reasonably verified.
5. Deposits
A deposit may be required to secure a commission booking.
Deposit amounts will be advised during the quotation process.
Deposits are non-refundable once work has commenced.
Any deposit paid will be deducted from the final artwork price.
6. Pricing
All prices are displayed in Australian Dollars (AUD) unless otherwise stated.
Prices may be updated at any time without notice. However, confirmed quotations will remain valid for the period specified within the quotation.
Shipping costs, customs duties, taxes, and import charges are not included unless expressly stated.
7. Payment
Full payment must be received before artwork is dispatched.
Accepted payment methods will be provided at the time of purchase or commission confirmation.
The artist reserves the right to withhold delivery until payment has been received in full.
8. Original Artworks
Original artworks are individually created by hand using professional-quality materials.
Availability of original artworks may vary, and the artist reserves the right to remove, modify, or update artwork listings at any time.
Ownership of the physical artwork transfers to the purchaser upon receipt of full payment.
Copyright remains with the artist unless otherwise agreed in writing.
9. Fine Art Prints
Fine Art Prints are professionally reproduced using archival-quality materials designed for exceptional detail and longevity.
Due to the nature of the printing process, slight colour variations may occur between screen displays and the final printed artwork.
Print sizes and availability may vary.
10. Shipping & Delivery
Original artworks and Fine Art Prints may be shipped within Australia and internationally.
Delivery timeframes are estimates only and may vary due to courier services, customs processing, weather conditions, and other factors beyond the artist's control.
International customers are responsible for any customs duties, taxes, import fees, or local charges imposed by their country.
Every effort is made to package artwork carefully and securely for transport.
11. Returns & Refunds
Original Artworks
Due to the unique nature of original artwork, returns are generally not accepted unless the artwork arrives damaged or an error has occurred.
Commissioned Artwork
Commissioned artwork is personalised and created specifically for the client.
For this reason, commissioned works are non-refundable once work has commenced.
Fine Art Prints
If a Fine Art Print arrives damaged, the purchaser must notify Sharan Miller Animal Art within seven (7) days of delivery and provide photographic evidence of the damage.
Where appropriate, a replacement or alternative resolution may be offered.
12. Intellectual Property & Copyright
All artwork, images, photographs, designs, logos, text, and website content remain the intellectual property of Sharan Miller unless otherwise agreed in writing.
Artwork may not be reproduced, copied, distributed, published, or used for commercial purposes without prior written permission.
The artist reserves the right to display commissioned artwork on her website, portfolio, social media platforms, marketing materials, and promotional content unless otherwise agreed in writing with the client.
13. Limitation of Liability
To the fullest extent permitted by law, Sharan Miller Animal Art shall not be liable for any indirect, incidental, special, or consequential loss arising from the use of this website, delays in delivery, purchases, or commissioned artwork.
Nothing within these Terms & Conditions excludes any rights that cannot legally be excluded under Australian Consumer Law.
14. Privacy
Information submitted through enquiry forms, email correspondence, or commission requests will only be used for the purpose of providing artwork-related services, customer support, and communication.
Personal information will not be sold or shared with third parties except where necessary to process orders, arrange delivery, or comply with legal obligations.
15. Website Use
Users must not misuse this website, attempt unauthorised access, introduce malicious software, or engage in unlawful activities.
The artist reserves the right to update website content, products, pricing, and services without notice.
